Better Choice IT – Terms of Service
1. Privacy Policy
We respect your privacy and take reasonable measures to protect your personal information. Information collected through our website or services is used only to provide products, services, support, billing, and communication related to your order.
We do not sell or redistribute your personal information to unrelated third parties unless required by law or necessary to complete services requested by you.
2. Payment Terms
Unless otherwise stated in writing, all services, subscriptions, consultations, and labor charges are prepaid and non-refundable once delivered or performed.
3. Refund Policy
Software, digital products, consultations, coaching, setup assistance, remote support, and labor services are non-refundable once delivered, scheduled, accessed, or performed.
Because software and digital services cannot be returned and labor time cannot be recovered, refunds will not be issued for:
• Change of mind
• Failure to use purchased services
• Customer incompatibility issues not caused by us
• Customer delays or lack of required information
• Services interrupted by customer-owned equipment, internet, or third-party providers
If a product or service is proven defective due to our direct error, we may, at our discretion, provide reasonable corrective action such as updates, rework, troubleshooting, or service adjustments.
4. Remote and Onsite Services
Remote and onsite services are labor-only services unless otherwise stated in writing.
• Workmanship is guaranteed for 30 days.
• Parts, hardware, software licenses, and supplies are typically purchased separately by the customer.
• Manufacturer warranties apply to third-party hardware and software products.
• Onsite services are intended for businesses managing their own IT systems and equipment.
• Hourly onsite labor may require a two-hour minimum unless otherwise agreed in writing.
5. Software and Digital Services
Software, subscriptions, digital downloads, website setup assistance, cloud services, and electronically delivered products are considered delivered once access instructions, download links, login credentials, or activation details have been sent to the customer.
Customers must notify us within 5 days if access or delivery issues occur.
6. Consultations and Coaching
Consultation and coaching services are based on time, experience, and professional guidance provided during scheduled sessions. Once services are delivered or sessions begin, refunds are not available.
7. Customer Responsibilities
Customers are responsible for:
• Maintaining backups of important data
• Providing accurate information and required access
• Maintaining active internet service for remote support
• Verifying compatibility of third-party products and services before purchase
Better Choice IT is not responsible for data loss, business interruption, third-party service failures, or customer-owned equipment issues unless caused directly by our gross negligence.
8. Account Suspension or Termination
We reserve the right to suspend or terminate services, accounts, or subscriptions without refund if:
• These Terms of Service are violated
• Services are abused or misused
• Fraudulent activity is suspected
• Customers become threatening, abusive, or harass staff or associates
9. Limitation of Liability
To the maximum extent permitted by law, Better Choice IT shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, downtime, or business interruption arising from use of our services or products.
10. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. Continued use of our website or services after updates constitutes acceptance of the revised terms.
